Terms & Conditions

1. Acceptance & Eligibility

• These Terms govern your use of the 1EV app, website, and Charging Management System ("Platform"), 1EV Hardware, and charging Stations, and bind every User, Enterprise Customer, dealer, and reseller ("you").
• By creating an account, booking a session, or purchasing Hardware, you accept these Terms.
• These Terms work with our Privacy Policy, Refund & Cancellation Policy, and the other policies published on the Platform. On commercial matters - fees, payments, liability, and warranties - these Terms prevail.
• You must be at least 18 and legally competent to contract in India. An entity accepting these Terms confirms it has authority to bind itself.

2. 1EV Services

• 1EV operates a unified charging Platform and aggregator of independent charging stations, operates the 1EV charging network, and supplies 1EV-branded Hardware manufactured for it by certified OEM partners, and separately serves Enterprise Customers, dealers, and resellers under dedicated agreements.
• 1EV Station - owned or operated by 1EV. Partner Station - owned by an independent operator and listed on the Platform.
• At Partner Stations, 1EV acts only as an intermediary platform. At 1EV Stations, 1EV acts as the operator and, where 1EV Hardware is installed, as the supplier of that Hardware.
• Each Station's ownership type is shown before booking; the matching liability, warranty, and compliance terms apply from that point.

3. Accounts & User Responsibilities

• You need a registered account for most features. Provide accurate information, keep your credentials confidential, and report unauthorized use immediately.
• You agree to use the Platform, Hardware, and Stations lawfully and as intended, and to verify vehicle and connector compatibility before charging.
• You agree not to tamper with, reverse-engineer, or install unauthorized firmware on Hardware, and not to misuse the Wallet or promotional credits.
• You are responsible for site infrastructure and permits for Hardware you purchase, unless your agreement states otherwise.

4. Booking, Charging & Payments

• Tariffs are set by the station operator (Partner Stations), by 1EV (1EV Stations), or by your Enterprise Agreement, and are shown before your session starts; that price applies for the session.
• A reservation must convert to a session within the disclosed grace period or it expires, with a no-show fee capped at the reservation fee. An idle fee may apply once published on the Platform.
• Displayed SOC/range data is indicative only; charging speed depends on your vehicle and grid conditions and is not guaranteed.
• Platform fees are itemized at checkout and may change with 7 days' notice. Amounts exclude tax unless stated.
• Payments are processed through authorised, secure gateways (UPI, cards, net banking, Wallet). Failed or duplicate transactions are reversed within 5–7 business days.
• Contact support before disputing a chargeback. 1EV may contest unwarranted chargebacks and pause accounts pending resolution of disputed or fraudulent claims.
• Wallet top-ups are non-refundable to your bank except on account closure, legal requirement, or error.

5. Refunds

• Refunds and cancellations are governed by our Refund & Cancellation Policy, which prevails over anything below.
• Indicative timelines: User cancellations are refunded per the tiered schedule (including the cooling-off window) in the Refund & Cancellation Policy; charger/operator-fault cancellations are refunded in full within 3–5 business days; interrupted sessions are refunded pro-rata within 5 business days; failed or duplicate payments reverse within 5–7 business days.

6. Hardware Warranty & Platform Disclaimer

• 1EV warrants, as supplier, that Hardware is free from material defects in materials and workmanship for 12 months from delivery or 18 months from manufacture, whichever is earlier, under normal use and installation.
• Excluded: unauthorized modification, non-certified installation, misuse, and normal wear of consumables.
• Remedy: repair, replacement, or pro-rata refund, at 1EV's discretion, through 1EV's service channel with proof of purchase.
• This warranty does not limit any non-excludable consumer right. Safety recalls and free remedies apply even after the warranty ends.
• The Platform (app, website, CMS) is provided without warranty of merchantability, fitness, or uninterrupted, error-free operation, and displayed charger availability is not guaranteed. This disclaimer does not limit the Hardware warranty above.

7. Intellectual Property & Privacy

• All intellectual property in the Platform - software, trademarks, and content - belongs to 1EV or its licensors. Intellectual property in 1EV Hardware - including hardware designs and firmware - belongs to 1EV's OEM partners and licensors; the 1EV brand and trade marks belong to 1EV.
• Purchasing Hardware gives no right to reverse-engineer, extract firmware, or replicate designs, other than a limited, separately licensed right to use published integration specifications for interoperability.
• We process personal data under applicable Indian data protection law and, for international Users, the GDPR. See our Privacy Policy for details and your rights.

8. Liability & Indemnity

• 1EV's liability is capped per claim: Partner Station bookings - the higher of 3 months' platform fees or ₹5,000; 1EV Station sessions - the higher of 3 months' fees or ₹10,000; Hardware bought directly - the price paid for that unit; Enterprise Customers - the cap in their Agreement, which governs instead.
• No cap limits liability that cannot lawfully be excluded, including for death, personal injury, or a non-disclaimable product-liability claim caused by proven negligence, gross negligence, wilful misconduct, or fraud. 1EV excludes indirect, consequential, and punitive damages, including lost profits, data, or goodwill.
• You indemnify 1EV against claims from your breach of these Terms, misuse, or unlawful conduct.
• 1EV indemnifies Enterprise Customers, dealers, and resellers, per their Agreement, against IP-infringement claims from documented use, and against injury or damage caused by a proven product defect in 1EV-branded Hardware not attributable to misuse or unauthorized installation.

9. Suspension & Termination

• These Terms take effect on acceptance and end as set out in these Terms, the policies published on the Platform, or your Enterprise Agreement.
• 1EV may suspend or terminate your account for breach of these Terms, fraud, or unlawful use.
• Fee, warranty, IP, confidentiality, indemnity, and liability clauses survive termination.

10. Governing Law & Dispute Resolution

• These Terms are governed by Indian law.
• Disputes go to arbitration under the Arbitration and Conciliation Act, 1996 before a sole arbitrator appointed by mutual agreement of the parties (failing agreement within 30 days, appointed under Section 11 of that Act), seated in Pune, Maharashtra, conducted in English, with a final and binding award. Courts at Pune, Maharashtra, India hold exclusive jurisdiction over non-arbitrable matters.
• Nothing in these Terms prevents a User from approaching the consumer dispute redressal fora under the Consumer Protection Act, 2019. International Users retain non-waivable home-jurisdiction consumer rights. Enterprise Agreements may set an alternate forum.
• Grievances are addressed under our Grievance Redressal Policy.

11. General Provisions

• Assignment - you need 1EV's written consent to assign these Terms; 1EV may assign them on a merger, acquisition, or asset sale.
• Force Majeure - neither party is liable for delays from events beyond its reasonable control, including component shortages, import restrictions, or regulatory delays.
• Confidentiality - each party protects the other's non-public information for 3 years after termination.
• Enterprise/Dealer Terms - Enterprise Customers, dealers, and resellers are additionally governed by their separate agreement, which prevails on pricing, credit terms, service levels, and territory.
• Severability & Waiver - invalid clauses are severed without affecting the rest; a waived breach does not waive future breaches.
• Entire Agreement - these Terms, our Policies, and any Enterprise Agreement form the whole agreement between you and 1EV. No partnership or agency relationship is created. English governs over any translation.
